Terms of Service & Store Policy

1. Overview & Contract Formation
This website is operated by Octavia Wild.
By placing an order and completing checkout, you confirm that you have read, understood, and agreed to this Store Policy in full. A binding contract is formed once payment has been successfully processed and your order has been accepted for production. We reserve the right to refuse or cancel any order prior to production commencement.
2. Nature of Artwork
Each artwork is produced to order using fine art materials and professional fine art printing processes by carefully selected fine art production partners. Fine art production partners, materials, substrates, and printing methods may vary based on artwork format, destination, and lab availability while maintaining our overall quality standards. This is a made-to-order process. Minor variations in colour, texture, scale, and finish are inherent to fine art production and do not constitute defects. These variations are accepted as part of the nature of the work.
By purchasing, you acknowledge and accept that:
-
all works are made to order
-
visual representations are digital interpretations
-
final output may vary slightly due to material and production processes
-
framing, scale, and colour may appear differently in real environments
This acknowledgment forms part of the purchase agreement.
3. Production
Production begins after payment confirmation. Once production has commenced, orders cannot usually be cancelled or amended because each artwork is produced specifically for your order. This does not affect any statutory rights that apply under applicable consumer law. Please review your order carefully before completing checkout. If you believe you have made an error, please contact us within 24 hours of placing your order and we will make every reasonable effort to assist before production begins, although changes cannot be guaranteed. Typical production timelines: typically up to 10 working days. Canvas printing may take longer.
Production times are estimates only and may vary due to operational, technical, or supply chain factors.
4. Shipping & Delivery
We ship internationally to most destinations worldwide, with limited exceptions.
Estimated delivery after dispatch:
-
North America: typically up to 15 business days
-
UK / Europe: typically up to 15 business days
-
Australia / New Zealand: typically up to 15 business days
-
Other regions: typically up to 30 business days
All shipments are fully tracked. Delivery dates are estimates only and are not guaranteed. Shipping windows do not include local customs clearance times. We are not liable for transit delays caused by customs holds or international carrier backlogs. Orders may be fulfilled by one of our international fine art production partners based on the artwork, print format, and delivery destination to help optimise production, reduce transit times, and, where possible, minimise customs charges.
5. Risk Transfer
Once an order has been delivered to the address provided at checkout and delivery has been confirmed by the carrier, responsibility for the artwork passes to the customer, except where applicable consumer law provides otherwise. Courier tracking confirmation may be used as evidence of delivery. We are not responsible for loss, theft, or damage occurring after courier tracking confirms successful delivery to the designated location. The customer is strictly responsible for providing a complete and correct shipping address at checkout. If a package is deemed undeliverable, returned to sender, or abandoned due to an incorrect or incomplete address, the customer may be responsible for any re-shipping fees. No refunds will be issued for errors in customer data entry.
6. Customs, Duties & Taxes
International orders crossing customs borders may be subject to import duties, local VAT, customs processing fees, or taxes imposed by the destination country. Where available, these charges may be collected prior to delivery. Otherwise, they are determined entirely by local authorities and remain the sole responsibility of the recipient. If a package is refused by the recipient due to unpaid customs charges, or if a package is returned/abandoned due to non-payment, any return shipping costs, customs clearance charges, storage costs, or carrier disposal fees incurred by us will be deducted from any applicable refund. If these fees exceed the total value of the order, no refund will be issued.
7. Returns & Cancellations
7.1 General Return Policy
Because each artwork is produced to order through our fine art production partners, sales are generally final. We do not offer returns, refunds, or exchanges for change of mind, incorrect size selection, or minor variations in screen calibration, except where required by applicable consumer protection laws.
7.2 UK & EU Consumer Right to Cancel
If you are a consumer residing in the United Kingdom or European Union purchasing standard catalog items, you have the statutory right to cancel your order within 14 calendar days from the date you (or a designated third party) take physical possession of the artwork.
To exercise this right, you must notify us in writing via email or using the contact form prior to the expiration of the 14-day window, providing your order number and a clear statement of your decision to cancel.
Exclusion: The statutory right to cancel does not apply to items produced to bespoke/custom dimensions requested by the buyer, custom framed prints, personalized works or other items legally classified as custom or tailored goods.
7.3 Return Conditions & Refunds
Where a statutory cancellation is accepted under Section 7.2:
Condition: Returned items must be completely unused in original mint condition, and safely wrapped in all original protective packaging (including paper, inner tissue, tubing, or protective corners).
Return Shipping Costs: The customer is strictly responsible for paying all direct return shipping costs.
Outward Shipping Refund: Upon receipt and inspection of the returned item, we will refund the price of the artwork plus standard outward shipping charges paid at checkout. If you selected an upgraded, express, or premium shipping option at checkout, the difference over standard shipping is non-refundable.
Transit Risk & Insurance: You must return the item using a tracked, fully insured courier service for the full retail value of the work. Responsibility and risk of loss or damage remain with the customer until received by us. If a return arrives damaged, creased, or is lost in transit, no refund will be issued, and you must claim compensation directly from your chosen courier. Proof of dispatch (such as a postal receipt) does not constitute proof of delivery. Responsibility remains with the customer until the artwork is physically received and signed for at our specified return address.
Refund Processing: Refunds will be issued via the original payment method within 14 days of us receiving and inspecting the returned artwork to verify its resalable condition. Deductions may be made for any loss in value of the goods resulting from unnecessary handling or missing/damaged original packaging.
7.4 International Orders (Outside UK/EU)
For all customers located outside the United Kingdom and European Union, all sales are strictly final. No returns, cancellations, or exchanges are accepted once production has commenced.
8. Damage & Issue Reporting
8.1 Consumer Orders
If your artwork arrives damaged or incorrect, please inspect it promptly and notify us within 48 hours of delivery wherever reasonably possible.
Required evidence:
-
Order number
-
Clear photos of the damaged artwork
-
Clear photos of the external packaging
-
Clear photo of the carrier shipping barcode label on the packaging
Once verified, we will arrange a replacement free of charge. Where required by our production partners for inspection or quality control purposes, we may request the return of the item. In such cases, we will provide a prepaid return label or cover reasonable return shipping costs. Please retain all original packaging until your claim is processed, as our production partners require this for transit damage verification.
8.2 Business / Trade / Corporate Orders
Trade, gallery, and corporate orders are subject to strict inspection obligations upon delivery.
Any claim must be submitted within 48 hours of delivery with full photographic documentation.
Failure to report within this timeframe may be treated as acceptance of goods in full condition, to the extent permitted by law.
We are not responsible for:
-
damage reported after installation or framing
-
issues arising after third-party handling
-
secondary transport or storage damage
9. Intellectual Property
All artworks, designs, imagery, and content remain the exclusive intellectual property of Octavia Wild.
No rights are transferred upon purchase. Reproduction, resale, distribution, or commercial use is strictly prohibited without prior written permission.
10. Payments
Payments are processed via secure third-party providers. We do not store payment details. We are not responsible for errors, failures, or processing issues arising from third-party payment systems.
11. Order Refusal
We reserve the right to refuse, cancel, or refund any order prior to production commencement, including but not limited to:
-
suspected fraud
-
pricing or listing errors
-
abusive or misuse behaviour
-
operational limitations
12. Liability Limitation
